Terms of Service

1. Acceptance of terms

By accessing or using Qonvo ("the Service") you agree to these Terms of Service. If you do not agree, do not use the Service. The Service lets you connect WhatsApp numbers to send and receive messages through a web interface, chatbots, campaigns and an API.

2. Important disclaimers

• We are not affiliated with, endorsed by, or connected to Meta Platforms, Inc., WhatsApp LLC, or their subsidiaries.
• We are an independent third-party service provider.
• You use your own WhatsApp numbers.

3. Eligibility

You must be at least 13 years old, have a valid WhatsApp account, have legal authority to accept these Terms, and comply with all applicable laws.

4. Account registration and security

Provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. Use a strong password, enable two-factor authentication, keep API keys secret, revoke keys that may be compromised, and tell us immediately about unauthorized access.

5. WhatsApp integration

You represent that you own or are authorized to use every number you connect, and that your use complies with WhatsApp's terms and policies. Unofficial connections work as a linked device of your number. We make no guarantee about WhatsApp's continued compatibility, its policies, or the status of your WhatsApp account.

The Service applies pacing, warm-up, caps and health monitoring to reduce the risk of restrictions, and may slow down or pause sending from a number to protect it. These measures reduce risk but cannot guarantee that WhatsApp will not restrict a number.

6. Acceptable use

You may not use the Service to:

• Send spam or unsolicited messages, or message people who have not agreed to hear from you
• Violate any law or regulation, or WhatsApp's terms and policies
• Infringe intellectual property rights
• Transmit malware or harmful code
• Harass, threaten, abuse, impersonate or defraud others
• Scrape or harvest data without authorization
• Interfere with the Service's operation or security, or try to bypass its sending limits

You must comply with applicable anti-spam and data protection laws (for example CAN-SPAM, GDPR and CASL), obtain the consents you need from recipients, and honor opt-out requests. The Service records opt-outs (such as replies of "STOP") and will not send marketing messages to contacts who opted out.

You are solely responsible for the content of messages sent through the Service and their consequences.

7. Plans, billing and quotas

• Plans set daily and monthly message limits, number limits and API access.
• Prices may change with 30 days' notice.
• Some plans include a trial; sending stops when the trial ends unless you choose a plan.
• Quotas reset daily and monthly, and unused quota does not roll over.
• Fees are non-refundable unless stated otherwise, and cancellation takes effect at the end of the current billing period.

8. Data and privacy

Our Privacy Policy is part of these Terms. The Service stores messages sent and received through your numbers to provide the inbox, chatbots and history, for your plan's retention period. You can access, update and delete your data at any time.

9. Account deletion

You can delete your account from Settings → Profile by confirming your password. We then permanently delete your personal information, numbers, session keys, contacts, message history and API keys. Deletion is irreversible. Payment records may be retained as required by law.

10. Limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA OR BUSINESS, SERVICE INTERRUPTIONS, OR THE ACTIONS OF THIRD PARTIES INCLUDING WHATSAPP.

We are not responsible for WhatsApp account restrictions or bans, changes to WhatsApp's policies, WhatsApp outages, or messages WhatsApp blocks or does not deliver.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages and expenses (including legal fees) arising from your use of the Service, your violation of these Terms or of any law or third-party right, and the messages you send.

12. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, engage in prohibited or fraudulent activity, fail to pay, or where required by law. On termination your access ends and your data is deleted as described in section 9.

13. Changes to these terms

We may update these Terms. We will post the new version here, update the date above, and notify you of material changes.
